1. Acceptance of These Terms

These Terms of Service (“Terms”) form a legally binding agreement between you and TC IP Holdings LLC, a company registered in the United States and operating as SageHomeowner (“we,” “us,” or “our”), and govern your access to and use of the website located at www.sagehomeowner.com and any related services (collectively, the “Service”).

By accessing the Service, submitting a quote request, or checking the box stating that you have read and agree to our Privacy Policy and Terms of Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. What SageHomeowner Does

SageHomeowner is a lead-generation service. When you request a quote for home services (such as roofing, siding, or solar), we collect your inquiry and then do one or more of the following: (a) contact you directly — ourselves or through our affiliated sales representatives — to discuss your project; and/or (b) offer your inquiry through our marketplace to another sales organization or to an independent home-service provider, who may then contact you.

We do not perform the home-improvement work itself. Any home-improvement services you decide to purchase are provided by an independent home-service provider, not by SageHomeowner. We do not supervise, guarantee, warrant, or insure that work, and we are not a party to any agreement, quote, estimate, contract, payment, workmanship, or dispute between you and any provider. Any services you obtain are at your own discretion and risk.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and relates to a property you own or are authorized to seek services for.

4. How the Service Works

• You submit a request. You provide your contact details, property type, ZIP code, service type, and urgency through our quote form.
• We act on your inquiry. We may contact you directly — ourselves or through affiliated sales representatives — and/or offer your inquiry on our marketplace to a sales organization or an independent home-service provider. See our Privacy Policy for full detail on how your information is shared.
• You are contacted. SageHomeowner, a sales organization, or a home-service provider may contact you to discuss your project, as described in Section 5.

5. Consent to Be Contacted (TCPA)

By submitting the quote form and checking the consent box, you expressly authorize SageHomeowner, its affiliated sales representatives, and any sales organization or home-service provider that receives your inquiry to contact you at the phone number and email address you provided — including by phone call, text/SMS message, prerecorded or auto-dialed (robocall) messages, and email — regarding your service request, in accordance with the Telephone Consumer Protection Act (TCPA) and applicable state laws.

Consent is not a condition of any purchase. You may opt out of further contact at any time by replying STOP to a text message, asking the caller to stop, or contacting us using the details in Section 15. Message and data rates may apply.

6. Your Responsibilities

• Provide accurate, current, and complete information when requesting a quote.
• Use the Service only for lawful purposes and only to seek services for a property you are authorized to act for.
• Independently verify the licensing, insurance, qualifications, references, and pricing of any provider before engaging or paying them.
• Conduct your own due diligence on, and negotiate directly with, any provider — we are not a party to that relationship.

7. Prohibited Conduct

You agree not to:

• Submit false, misleading, or fraudulent information, or another person’s information without their authorization.
• Use the Service to send spam, harvest data, or solicit professionals or other users.
• Access the Service by automated means (bots, scrapers) except for search-engine crawlers acting in accordance with our robots.txt.
• Attempt to gain unauthorized access to the Service, its servers, or the administrative area, or to probe, scan, or test the vulnerability of any system.
• Interfere with or disrupt the Service, or transmit any virus, malware, or other harmful code.
• Reproduce, copy, resell, or exploit any portion of the Service without our express written permission.

8. Intellectual Property

The Service and all of its content — including text, articles, graphics, logos, the SageHomeowner name and mascot, and software — are owned by TC IP Holdings LLC or its licensors and are protected by United States and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use of requesting home-service quotes. All rights not expressly granted are reserved.

9. Third Parties and Links

The sales organizations and independent home-service providers who receive your inquiry are not our employees, agents, or partners, and we do not endorse, recommend, or guarantee any of them. The Service may also contain links to third-party websites that we do not control. We are not responsible for the content, products, services, conduct, or privacy practices of any third party, and your dealings with them are solely between you and that third party.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that any defects will be corrected, or that any professional you are matched with will meet your expectations, be properly licensed or insured, or perform satisfactorily. You use the Service and engage any professional at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TC IP HOLDINGS LLC OR ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR ANY INTERACTION WITH, OR WORK PERFORMED BY, ANY THIRD-PARTY PROFESSIONAL, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless TC IP Holdings LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or the rights of any third party, or any dispute between you and a sales organization or provider you were connected with.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share your personal information, and describes your privacy rights (including the right to opt out of the sale of your personal information). By using the Service you acknowledge that you have reviewed the Privacy Policy.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us using the details in Section 15 and attempt in good faith to resolve the dispute informally.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective date” at the top of this page. Your continued use of the Service after any change constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

16. Termination

We may suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms or for any other reason in our sole discretion. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

17. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely.
